Terms of use.
Plain terms for a game. Apple’s licence does most of the work; these are the few things particular to this one.
The licence
Marshmallow Diner is made by UPLATEGARAGE (sole trader, Australia, ABN 84 940 108 904). It is licensed to you, not sold, under Apple’s Standard Licensed Application End User License Agreement ↗. These terms add a few things that are particular to this game. Where they and Apple’s agreement differ, Apple’s agreement wins.
Remove Ads
Remove Ads is a single, one-time purchase made through the App Store. It removes the ads, unlocks all four flavours for good, adds a one-time gift of sprinkles, and makes revives free of ads. The App Store sets the price in your currency and handles the payment and any refund under its own rules. Restore it on any iPhone signed in with the same Apple ID.
Sprinkles
Sprinkles are earned in the game and are never sold. They have no cash value, can’t be bought, sold or transferred, and live only on your iPhone. A flavour borrowed with sprinkles relocks after five days. A flavour earned through a milestone, or unlocked by Remove Ads, stays yours.
Leaderboards
The leaderboards are Apple’s Game Center, and Apple’s terms apply to them. Please play them straight: a score made by changing the game or its saved data isn’t a score.
Changes to the game
Updates can change the game — its levels, its balance, what sprinkles buy — and can change these terms. A change to these terms gets a new date at the top of this page.
The fine print
The game is provided as it is, to the extent the law allows. Nothing in these terms excludes, restricts or changes any right you have under the Australian Consumer Law, or under any other law that can’t be excluded where you live.
